CARRY THE CROSS FOUNDATION (“Foundation,” “we,” “us,” or “our”) is a Texas nonprofit corporation and IRS 501(c)(3) organization (Charity ID / EIN: 41-2679902). Our official website is https://carrythecrossfoundation.org (the “Website”).

This page contains our Privacy Policy and Terms of Use. By using the Website, donating, volunteering, submitting a form or story, or contacting us, you agree to both. If you do not agree, do not use the Website.

We may update this page. The new date will appear at the top. Continued use after a change means you accept the updated version.

PRIVACY POLICY

We collect and use personal information only to operate the Foundation and serve our mission. This Policy explains what we collect, how we use it, and your choices.

We are not a medical provider and are not a “covered entity” under HIPAA. Information you share with us is not a medical record.

Donor privacy. We do not sell, share, or trade donor names or personal information with other organizations. We do not send mailings on behalf of other organizations.

CARRY THE CROSS FOUNDATION does not share mobile numbers, text messaging originator opt-in data, or consent with any third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

By contacting us via SMS with your mobile number, you consent to receive marketing text messages from CARRY THE CROSS FOUNDATION. Msg&Data rates may apply. Message frequency varies. Text HELP for help. Reply "STOP" at any time to opt out.

Customers see our phone number on https://carrythecrossfoundation.org/contact-us. They opt in by texting that number first. We reply to that inbound text. Carriers are not liable for delayed or undelivered messages. Consent is not required to donate or to receive help by email.

Texas privacy law. As a nonprofit, we are exempt from the Texas Data Privacy and Security Act. We still use reasonable safeguards to protect personal information.

1. Information we collect

Name, postal address, email, and phone number you provide on donation, volunteer, membership, story, newsletter, or contact forms.
Donation amount, date, and receipt details. Payment-card data is processed by our donation platform (currently Zeffy). We do not store full card numbers.
Mobile number and SMS opt-in when you text (972) 846-9640.
Device and usage data collected automatically (IP address, browser type, pages viewed) to operate and improve the Website.
Information you voluntarily share for advocacy or assistance, such as a personal story.

We do not knowingly collect personal information from children under 13. If you believe we have, email info@carrythecrossfoundation.org and we will delete it.

2. How we collect it

Directly from you (forms, email, phone, text, mail, social media).
Automatically through cookies and similar tools, which may include Google Analytics.
From service providers that process donations, email, hosting, analytics, or text-message delivery, only as needed to run the Foundation.

You may block cookies in your browser. Some site features may not work if you do.

3. How we use it

Process donations and issue tax receipts.
Respond to questions and coordinate programs.
Send mission-related email if you provided an address for that purpose.
Send or reply to text messages after you text (972) 846-9640.
Improve the Website and report anonymized impact.
Meet legal duties, including IRS recordkeeping.

We do not sell personal information or use it for unrelated commercial marketing.

4. When we share it

We share personal information only:

With service providers bound to use it only for our purposes (donation processing, email or text delivery, hosting, analytics). Text-message aggregators and providers may receive numbers only to deliver messages. They may not use SMS opt-in data for their own marketing.
With a partner, and only with your consent, if needed to coordinate help you requested.
When required by law, or to protect the Foundation, our users, or others.
If Foundation assets are transferred to another 501(c)(3) that agrees to honor this Policy.

We may share aggregated or de-identified information that cannot reasonably identify you.

5. Security, retention, and breach notice

We use reasonable administrative, technical, and physical safeguards. No method of transmission or storage is fully secure.

We keep donor records as long as IRS rules require (generally seven years), then delete or anonymize them.

If we discover a breach of sensitive personal information we own or license, we will notify affected Texas residents as required by Texas Business & Commerce Code Chapter 521.

6. Your choices

Email info@carrythecrossfoundation.org to access, correct, or request deletion of your information, except records we must keep by law.

Unsubscribe from emails using the link in the message or by emailing us.

Reply STOP to opt out of texts.

We do not sell personal information.

TERMS OF USE

1. Who we are

The Foundation provides education, advocacy, spiritual companionship, and charitable support related to elderly care and independent providers. This Website is our official public site.

We are not a hospital, clinic, home-health agency, insurer, or law firm. Use of this Website does not create a patient, client, or professional relationship.

2. Eligibility

The Website is intended for adults in the United States. You must be at least 18 to donate, volunteer, submit a story, or request assistance through the site. If you are under 18, use the Website only with a parent or guardian.

3. No medical, legal, or financial advice

Website content—including articles, reports, directories, pledges, videos, and stories—is for general information, education, and advocacy only. It is not a diagnosis, treatment plan, legal opinion, insurance advice, or substitute for professional care. Consult a licensed professional about your own situation. Do not delay care because of something you read here.

4. Donations

Gifts are voluntary. The Foundation is recognized by the IRS as exempt under Internal Revenue Code section 501(c)(3). Contributions are tax-deductible to the extent allowed by law. This is not tax advice.

Unless we state otherwise in writing, no goods or services are provided in exchange for a standard online gift. We will provide a written acknowledgment for gifts of $250 or more. Keep your receipt.

Online payments are processed by Zeffy. Zeffy’s terms and privacy policy apply to the payment step. We do not store full payment-card numbers.

A donation does not purchase services or influence over Foundation decisions. To stop a recurring gift, email info@carrythecrossfoundation.org. We may decline or return a gift if accepting it would violate law or our policies.

5. Membership, volunteering, forms, and texts

Website “membership” or similar programs may be free and do not create employment, partnership, or agency. Volunteers are unpaid unless we agree otherwise in writing.

Information you submit must be accurate to the best of your knowledge. Do not impersonate anyone or submit another person’s private information without permission.

Signing up for our email list is not consent to text. Text consent is obtained when you contact us by SMS at (972) 846-9640.

6. Stories and user content

If you send a story, photo, comment, testimonial, or other material (“User Content”), you represent that you have the right to share it.

You grant the Foundation a royalty-free, worldwide license to use, display, edit for length or clarity, and share that User Content for our nonprofit mission, unless you mark it confidential or ask us in writing not to publish it.

Do not include another person’s name, photo, or health details without their consent. We may refuse or remove User Content that is unlawful, misleading, harmful, or inconsistent with our mission.

7. Acceptable use

You agree not to:

Use the Website for any unlawful purpose.
Harass, threaten, or defame any person.
Upload malware or attempt to disrupt our systems.
Scrape or harvest site data for commercial use without written permission.
Post spam, deceptive fundraising, or infringing content.
Interfere with other users’ access.

We may remove content, suspend access, or report activity to authorities.

8. Intellectual property

You may view and print pages for personal, non-commercial use and share links or short excerpts with credit to Carry the Cross Foundation. You may not copy the site, logo, or reports for commercial use, or present our materials as your own, without prior written permission.

9. Third-party sites

Links to donation processors, social networks, government sites, news, or partners are not under our control. Their terms and privacy policies apply when you leave our site.

10. Email and SMS

If you give us an email address, we may send mission-related email. Unsubscribe using the link in the message.

If you text (972) 846-9640, we may text you as described above. Carriers are not liable for delayed or undelivered messages.

11. Disclaimer of warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Website will be uninterrupted, accurate, or free of errors or harmful code.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE OR RELIANCE ON ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE WEBSITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU DONATED TO THE FOUNDATION IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow certain limitations. If those laws apply to you, some of the above may not apply.

13. Indemnity

You agree to defend, indemnify, and hold harmless the Foundation and its officers, directors, employees, and volunteers from claims, damages, and reasonable attorneys’ fees arising from your misuse of the Website, your User Content, or your violation of these Terms or of another person’s rights.

14. Termination

We may suspend or end access to the Website at any time if these Terms are violated or if we discontinue the site. Sections that should reasonably survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Except where prohibited, any dispute will be resolved in the state or federal courts located in Dallas County, Texas.

16. General

If any part of these Terms is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. This Privacy Policy and these Terms of Use are the entire agreement between you and the Foundation regarding the Website.
